Certificate of Spanish nacionality for films

Spanish nationality will be granted to all cinematographic films and audiovisual works executed by a Spanish production company, or belonging to another European Union Member State and established in Spain, to which a Spanish nationality certificate is issued, after confirming that the following requirements are met:

  • The range of authors of the cinematographic film or other audiovisual work (i.e. the director, screenwriter, director of photography and music composer) consists, at least by 75%, of persons with Spanish nationality or another European Union Member State, signatory states of the European Economic Area Treaty, or who holds a valid residence card or permit in Spain or in any of such States. In any case, the director must always meet this requirement.
  • The actors and other artists participating in the production of (one) cinematographic film or audiovisual work are represented by at least 75% by persons meeting the nationality or residence requirements established above.
  • All technical creative staff, and other technical staff participating in the production of (one) cinematographic film or audiovisual work are represented, each one, by at least 75% by persons meeting the nationality or residence requirements established in paragraph one above.
  • The cinematographic film or other audiovisual work is preferably produced in its original version, in any official language of the Spanish state.
  • The shooting, unless otherwise required by the script, studio post-production and laboratory tasks are all completed in Spain or in other European Union Member States. For animation works, production processes must also be completed in these territories.

Furthermore, cinematographic films or audiovisual works will be deemed as Spanish if jointly produced with foreign companies and approved as such.

A Spanish nationality certificate will be issued by ICAA or by the competent body in each Autonomous Community, at the request o the producer or distributor, upon completion of the production of the cinematographic film or audiovisual work. Said request may be filed at the same time as the rating application.

In order to ascertain that all these nationality requirements are met, the applicant will provide:

  • A technical-artistic file of the film or audiovisual work, stating the nationality of all technical creative staff and other technical staff.
  • Shooting locations. If shooting has taken place outside the European Union, it must be explained that this was due to screenwriting requirements.
  • Any laboratories and post-production studios participating in its creation.
  • Original version.

This certificate will be issued within a maximum of one month following the filing of the request. For television series, a nationality certificate will be issued within a maximum of one month whenever the number of season episodes is less than or equal to twenty, and within a maximum of two months if greater.
If no resolution is issued upon expiry of these deadlines, Spanish nationality will be deemed as granted further to the principle of positive silence.

A nationality certificate will be a necessary requirement to be eligible for the financial aid foreseen in Film Act 55/2007, of 28 December. The failure to obtain a nationality certificate for the produced work will require a reimbursement of the financial aid received.
